Terms of Service

These Terms of Service (“Terms”) govern your use of https://capsulelater.com and the Capsule Later reservation service (“Capsule Later,” “we,” “us,” or “our” ). By using the website or purchasing a capsule reservation, you agree to these Terms.

If you do not agree with these Terms, do not use Capsule Later.

1. The Capsule Later service

Capsule Later allows users to reserve a digital slot associated with a future capsule year. A reservation may contain a text message, link, or image.

The number of slots, available years, reservation price, release date, and sealing rules may be displayed on the website and may change before a reservation is completed.

A reservation does not guarantee that content will be available forever, searchable publicly, or accessible in every format. We may modify or discontinue parts of the service as described in these Terms.

2. Eligibility

You must be legally able to enter into a contract in your location to use Capsule Later or purchase a reservation.

If you are under the age required to make purchases in your jurisdiction, you may use Capsule Later only with the involvement and permission of a parent or legal guardian.

3. Reservations and payment

Each reservation costs $3.00 per slot, unless a different price is clearly displayed at checkout.

Payments are processed by Stripe. By completing checkout, you authorize the payment provider to charge your selected payment method for the displayed amount.

A reservation is not complete until:

1. Payment has been successfully processed; and
2. Capsule Later has received confirmation of the payment.

If payment is completed but the reservation cannot be created because of a technical problem, duplicate reservation, or other service error, Capsule Later may cancel the reservation and issue a refund.

We may refuse or cancel a reservation when necessary to prevent fraud, abuse, technical errors, or violations of these Terms.

4. Refunds

Capsule Later reservations may be refunded within 7 days of purchase, provided the capsule content has not yet been published, released, or permanently sealed.

We may also issue refunds for:

• Duplicate payments
• Technical errors
• Payments for reservations that could not be created
• Other circumstances we determine are appropriate

After the applicable capsule has been sealed or the content has been released, reservations are generally non-refundable.

Refunds are returned to the original payment method. Processing times depend on the payment provider and the customer’s bank or card issuer.

This policy does not limit any non-waivable consumer rights that apply under local law.

5. User content

You may submit messages, links, images, and other material to Capsule Later (“User Content”).

You are solely responsible for your User Content. By submitting User Content, you represent and warrant that:

• You own it or have permission to submit it.
• You have the necessary rights, licenses, and permissions for Capsule Later to store, display, reproduce, and process it.
• It does not violate another person’s privacy, publicity, copyright, trademark, or other rights.
• It is not unlawful, fraudulent, defamatory, threatening, abusive, hateful, sexually explicit, or harmful.
• It does not contain malware, malicious code, or unauthorized advertising.
• It does not include passwords, payment-card information, government identification numbers, or other highly sensitive information.

You retain ownership of your User Content. However, you grant Capsule Later a worldwide, non-exclusive, royalty-free license to host, store, copy, format, display, transmit, and otherwise process your User Content as needed to operate, maintain, promote, and improve the service.

This license continues for as long as reasonably necessary to operate the applicable capsule, comply with legal obligations, resolve disputes, maintain backups, and enforce these Terms.

6. Capsule release and sealing

Content may be held until a future date and may later be made available according to the capsule’s published rules.

You are responsible for selecting the correct year and reviewing your content before payment.

After a capsule is sealed, released, or otherwise processed according to its rules, Capsule Later may not be able to edit, remove, replace, or refund the associated content.

We do not guarantee that a future capsule will remain available without interruption or that future devices, browsers, file formats, or technologies will support every type of content.

7. Prohibited use

You may not use Capsule Later to:

• Break the law or encourage unlawful conduct.
• Infringe intellectual-property or privacy rights.
• Harass, threaten, stalk, impersonate, or defame another person.
• Submit personal information about another person without permission.
• Upload malware, malicious code, or harmful files.
• Attempt to gain unauthorized access to the website or another user’s content.
• Interfere with the service or overload its infrastructure.
• Submit fraudulent payment information.
• Circumvent reservation limits or payment controls.
• Use automated systems to abuse, scrape, or manipulate the service.
• Submit content intended to exploit, harm, or endanger children.

We may remove content, cancel reservations, restrict access, or take other appropriate action when we believe these Terms or applicable law may have been violated.

8. Content review and removal

We are not obligated to monitor all User Content. However, we may review, remove, restrict, or preserve content when necessary to:

• Operate and protect the service.
• Comply with law, court orders, or governmental requests.
• Investigate abuse, fraud, or security incidents.
• Enforce these Terms.
• Protect users, third parties, or our rights.

9. Intellectual property

The Capsule Later name, logo, website design, software, text, graphics, and other materials provided by Capsule Later are owned by Capsule Later or its licensors and are protected by applicable intellectual-property laws.

Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, publish, reverse engineer, or create derivative works from Capsule Later materials.

10. Third-party services

Capsule Later may rely on third-party services, including hosting providers, payment processors, analytics tools, security services, and content-delivery services.

Third-party services may have their own terms and privacy policies. Capsule Later is not responsible for failures, policies, or actions of third-party services outside its reasonable control.

11. Disclaimers

Capsule Later is provided on an “as is” and “as available” basis to the fullest extent permitted by law.

Capsule Later does not guarantee that:

• The service will always be available or uninterrupted.
• The service will be error-free or completely secure.
• Content will never be lost, corrupted, altered, or inaccessible.
• Every reservation will remain available for the entire intended period.
• The service will meet every particular purpose or expectation.
• Future technology will support the service or stored content.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

12. Limitation of liability

To the fullest extent permitted by law, Capsule Later and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, content, profits, revenue, goodwill, or business opportunities.

To the fullest extent permitted by law, total liability relating to the service or a reservation will not exceed the amount paid to Capsule Later for the reservation giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some provisions may not apply to you.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Capsule Later and its owners, operators, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:

• Your use of the service.
• Your User Content.
• Your violation of these Terms.
• Your violation of another person’s rights or applicable law.

14. Account suspension and termination

Capsule Later may suspend or terminate access, cancel reservations, or remove content if:

• You violate these Terms.
• Fraud, abuse, or unauthorized activity is suspected.
• Required by law or a payment provider.
• Necessary to protect the service or other users.
• Capsule Later discontinues or materially changes the service.

Terms concerning User Content, intellectual property, payment obligations, disclaimers, limitations of liability, indemnification, disputes, and other provisions that should reasonably survive termination will continue to apply.

15. Changes to the service or these Terms

Capsule Later may update the service or these Terms from time to time. The updated Terms will be posted on this page and the “Last updated” date will be revised.

Your continued use of Capsule Later after updated Terms are posted means you accept the revised Terms. If a change materially affects your rights, additional notice may be provided where required by law.

16. Governing law and disputes

These Terms are governed by the applicable laws of the jurisdiction in which Capsule Later operates, without regard to conflict-of-law principles.

Before filing a formal claim, please contact Capsule Later at kashinit@gmail.com so we can try to resolve the issue informally.

Nothing in this section limits any rights you may have under mandatory consumer-protection laws.
